Korea’s Probability Disclosure Enforcement in Practice: A Recent MCST Case

Korea Continues Enforcement of Probability Disclosure Rules

Korean authorities continue to enforce mandatory probability-based item disclosure requirements.

On September 10, 2026, Korea’s Ministry of Culture, Sports and Tourism (MCST) issued Public Notice No. 2026-0362 concerning a probability-based item disclosure violation.

The notice involved the public notification of a prior notice of a corrective order and an opportunity to submit an opinion.

Importantly, this was a prior notice—not a finalized corrective order.

For overseas game publishers, the case highlights two important areas of Korean compliance: accurate probability disclosure and reliable regulatory communication.

Why Does Public Notification Matter?

Administrative notices are normally delivered directly to the relevant party. However, Korean administrative procedures allow public notification to be used in certain circumstances where ordinary service cannot be completed.

For overseas publishers, this means that difficulty receiving a regulatory notice directly does not necessarily prevent the administrative process from moving forward through legally available procedures.

Maintaining an effective channel for Korean regulatory communications is therefore an important part of compliance management.

What Should Overseas Game Publishers Check?

Korea’s mandatory probability disclosure regime has been in effect since March 22, 2024.

Publishers offering probability-based items in Korea should regularly confirm that:

  • required probability information is properly disclosed;
  • published probabilities match actual in-game settings;
  • Korean disclosures are updated when probability settings change; and
  • communications from Korean regulatory authorities can be received and escalated promptly.

For companies subject to Korea’s Domestic Agent requirement, communication between the overseas publisher and its Korean Domestic Agent should also be regularly reviewed.

A Domestic Agent should function as an effective regulatory communication channel—not simply as a formal appointment.

Key Takeaway

The September 10 public notice does not introduce a new probability disclosure requirement.

Instead, it illustrates the practical importance of maintaining both accurate probability disclosures and reliable regulatory communication channels in Korea.

For overseas publishers, Korean compliance does not end when probability information is published. Companies also need processes to keep that information accurate and respond promptly when regulatory issues arise.
